THE U.S. DEPARTMENT OF LABOR (DOL) AND THE INTERNAL REVENUE SERVICE (IRS) ARE CHARGED WITH THE ENFORCEMENT OF ERISA (THE EMPLOYEE RETIREMENT INCOME SECURITY ACT OF 1974) AND THE RELATED SECTIONS OF THE INTERNAL REVENUE CODE (IRC).  

Generally, Federal law requires employee benefit plans with 100 or more participants to have an audit as part of their obligation to file an annual return/report (Form 5500) that must be generated by an independent qualified CPA.
